Terms and conditions
All clients booking a place on a Smart Boot Camp should be aware of and accept any potential risks associated with the activities on the camp.
It is recommended that for your own protection you take Personal Accident and cancellation Insurance.
Smart Boot Camp Ltd., accepts bookings subject to the following conditions:
In this Agreement, unless the context otherwise requires, the following expressions have the following meanings:
Booking A booking made by the client with SBC as set out on the booking form.
Booking Form The booking form produced by SBC to be completed by the client upon making a booking.
Contract The contract between the client and SBC under which the services are to be provided by SBC to the client.
Client The person, firm or company who makes a booking with SBC. All individuals to whom the services are provided by SBC must be at least 18.
Deposit An amount equal to 25% of the total fee is payable upon booking. The full balance must be paid 28 days prior to the start of the SBC. Any bookings made within the final 28 days must be paid in full at the time of booking.
Cancellations All cancellations will incur a £50 administration charge. Any cancellations made within the final 28 days will lose the full balance, including deposit.
Fee The amount payable to SBC under the contract.
Force Majeure Any act, event, omission or accident beyond the reasonable control of SBC including, but not limited to, an Act of God, war, riot, civil commotion, malicious damage, compliance with any law or government order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm, adverse weather, default of suppliers or subcontractors, strikes, lock-outs or other industrial disputes, failure of a utility service or transport network.
Major Change A change in the date, location or content of the camp.
SBC Smart Boot Camp Limited.
Recordings Photographs, videos or any other visual recordings taken of clients while participating in a Smart Boot Camp.
Services The activities and services provided by SBC to the client under the terms of the contract.
1 Wording importing the singular meaning shall include the plural meaning and vice versa.
2 All wording within the booking conditions is generalised and reference to any gender includes the other genders.
3 A contract for the services is made between SBC and the client on the issue of written confirmation of booking by SBC.
4 The contract is subject to these booking conditions which the client has been deemed to have read and fully understood. These booking conditions cannot be changed without prior written agreement between SBC and the client.
5 No verbal representations made by SBC shall be relied upon by the client.
6 To place a booking, SBC requires a completed booking form together with the deposit and confirmation that the terms and conditions have been read, understood and accepted. If a booking is made by telephone or email the client should have read and fully understood all of the terms and conditions and signed the declaration on the booking form. All bookings are provisional and are only confirmed once the deposit has cleared in SBC’s bank account.
7 SBC reserves the right to decline any booking at their discretion.
8 Following cleared payment of the client’s deposit, a contract is formed for the agreed programme.
9 The full balance is payable 28 days before the start of the SBC unless otherwise stated. In the event of the balance not being paid, SBC has the discretion to treat the booking as cancelled by the client and re-sell the course place. The deposit is none refundable.
10 The fee does not include travel to and from the Smart Boot Camp accommodation. This is the responsibility of the individual clients.
11 Each client is responsible for their own personal medical requirements, clothing and footwear while taking part in Smart Boot Camp. Advice on appropriate footwear and clothing will be provided.
12 It is the responsibility of the client to inform SBC in writing of any health issues which may make them unsuitable to participate in certain activities. Failure to disclose any such information may result in SBC terminating the contract and with-drawing the client from SBC without a refund.
13 SBC reserves the right to change any price or other particulars of the camp before the contract becomes binding.
14 In the unlikely event of any “major” changes, SBC will notify the client and make arrangements as close to the original as is reasonably possible under the circumstances, this may be an alternative date being offered or a full refund.
15 In the event of any changes, other than a major change, SBC is not obliged to inform the client in advance or obliged to pay any compensation.
16 SBC will always endeavour to fulfill confirmed bookings but SBC does reserve the right to cancel. If SBC cancels a booking prior to the commencement of the camp the client will be offered an alternative date or a full refund.
17 The client is unable to assign or transfer their contract to a third party without the prior written consent of SBC. If the client wishes to assign their contract, he or she must give notice in writing providing the full name and address and contact details of the third party. SBC will advise in writing as to whether it consents to the change in name as soon as reasonably possible and if the transfer to a third party is not possible then the cancellation charges set out above apply.
18 SBC may assign or sub-contract to any third party the performance of any of its obligations under the contract without prior consent of the client.
19 SBC reserves the right to alter the content of its services at any time without notifying the client due to certain factors including but not limited to the weather and physical fitness of the clients.
20 Any information on our services published by SBC for its literature and website is designed for illustrative purposes only.
21 If the client elects not to participate in any part of the services being provided, SBC has no obligation to provide an alternative activity or service and the client will not be entitled to any refund.
22 If SBC believes a client’s health or safety is at risk or a client has failed to disclose any relevant health information as stated in condition 12 SBC may at its absolute discretion terminate the contract immediately without refund.
23 The client must refrain from any illegal act or any conduct which may give offence or cause danger or damage to any person or property while participating in a SBC. If SBC or any of its staff, consultants or agents, become aware of any such action then SBC or any of its suppliers may at their absolute discretion have the client immediately removed from any property or facility without refund. SBC will have no liability to the client in these circumstances.
24 Should there be a problem, the client must report it in the first instance to the SBC course manager or one of the instructors. If it is still unresolved then the issue should be reported immediately to a Director of SBC so all efforts can be made to resolve the problem promptly and effectively. In the unlikely event that the problem cannot be resolved and the client wishes to make a complaint then the client must notify SBC in writing giving full details within 14 days of the end of the services. Failure to service notice of the complaint in accordance with the above will preclude the client from being entitled to take any further action against SBC.
25 The client understands that attending any activity or service provided by SBC involves some level of risk. These risks include but are not limited to physical injury or even death. By attending any activity or service provided by SBC the client agrees to assume these risks and agrees to release and discharge SBC and its directors, employees and agents from any and all claims for liability.
26 Neither SBC nor any of its directors, employees or agents will be liable for any loss or damage to any personal property or vehicle belonging to the client during the services.
27 SBC reserves the right to take any recordings of clients during the services and the client accepts that all rights whatsoever arising in the recordings shall be solely owned by SBC.
28 The Client accepts and agrees that any recordings may be used by SBC at its absolute discretion in any manner including but not limited to its website, promotional material and advertisements.
29 SBC reserves all copyright which may subsist in the products of, or in connection with, the provision of the all activities, services or facilities. SBC reserves the right to take such actions as may be appropriate to restrain or prevent infringement of such copyright.
These terms and conditions shall be governed and construed in accordance with English and Welsh law and the parties shall submit to the non-exclusive jurisdiction of the English and Welsh courts.
